1. About Renting Hive

Renting Hive is an online marketplace that connects individuals ("Owners") who wish to rent out personal property with individuals ("Renters") who wish to rent such property. Renting Hive is not a party to any rental transaction. Renting Hive does not own, possess, control, or inspect any item listed on the Platform.

2. Renting Hive is a Marketplace Only — No Liability for Transactions

RENTING HIVE IS A TECHNOLOGY PLATFORM ONLY. RENTING HIVE IS NOT RESPONSIBLE FOR, AND EXPRESSLY DISCLAIMS ALL LIABILITY FOR, ANY DAMAGE, LOSS, THEFT, DESTRUCTION, INJURY, OR HARM TO ANY PERSON OR PROPERTY ARISING OUT OF OR IN CONNECTION WITH ANY RENTAL TRANSACTION CONDUCTED THROUGH THE PLATFORM.

This includes but is not limited to: damage to the rented item caused by the Renter; damage to the Renter's property caused by the rented item; theft or non-return of rented items; personal injury arising from use of a rented item; any loss resulting from a fraudulent, misleading, or inaccurate listing.

3. Scam Awareness and User Due Diligence

The Platform connects strangers. Fraudulent actors may attempt to exploit peer-to-peer marketplaces. Renting Hive does not verify the identity, credentials, or honesty of any user. You are responsible for your own safety and financial protection. Renting Hive strongly recommends:

• Meet in a public place when exchanging items whenever possible.
• Document the item's condition with photos and video before and after the rental period.
• Collect identifying information from the other party — all of which is provided by the Platform upon rental confirmation.
• Do not send money outside the Platform. Any request to pay via wire transfer, gift card, cryptocurrency, or other off-platform method is a strong indicator of fraud.
• Trust your instincts. If something feels wrong, cancel the transaction and report the user.
• Never release an item without confirmed payment through the Platform.

4. User Accounts

To list or rent items on the Platform you must create an account. You agree to provide accurate, current, and complete information including your legal name, a valid email address, and a valid phone number. You are responsible for all activity that occurs under your account.

5. Listings

Owners are solely responsible for the accuracy, legality, and completeness of their listings. By creating a listing you represent and warrant that you own the item or have the legal right to rent it, the item is accurately described, and the item is legal to own and rent in your jurisdiction.

Renting Hive reserves the right to remove any listing at any time for any reason without notice.

6. Payments and Fees

All payments are processed through Stripe. Renting Hive charges Owners a platform fee deducted from each rental payout at the time of the transaction. Credit card processing fees are charged to the Renter and are non-refundable in the event of a cancellation, dispute, or refund.

7. Contact Information Sharing

Upon completion of a successful rental payment, Renting Hive will share the Owner's name, email address, and phone number with the Renter, and vice versa, for the sole purpose of coordinating the in-person exchange. You consent to this disclosure by completing a rental transaction.

8. Prohibited Conduct

You agree not to use the Platform to:

• List or rent illegal items or controlled substances.
• Engage in fraud, misrepresentation, or deceptive practices.
• Circumvent the Platform's payment system to conduct off-platform transactions.
• Create fake or duplicate accounts.
• Scrape or reproduce the Platform's content without written permission.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RENTING HIVE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF THE PLATFORM OR ANY RENTAL TRANSACTION. IN NO EVENT SHALL RENTING HIVE'S TOTAL LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE TOTAL PLATFORM FEES PAID BY YOU IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

11. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Agreement to Arbitrate. You and Renting Hive agree that any dispute arising out of or relating to these Terms or the use of the Platform shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Fulton County, Georgia.

Class Action Waiver. YOU AND RENTING HIVE AGREE THAT EACH MAY BRING CLAIMS ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION.

Opt-Out. You may opt out by sending written notice to [email protected] within thirty (30) days of first accepting these Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of Georgia, without regard to its conflict of law provisions.

13. Modifications

Renting Hive reserves the right to modify these Terms at any time. Your continued use of the Platform after the effective date of any modification constitutes your acceptance of the updated Terms.

15. Electronic Communications

By creating an account on Renting Hive, you consent to receive electronic communications from us. These communications are transactional in nature and are essential to the operation of the Platform. They include, but are not limited to: purchase receipts, handoff confirmations, password resets, account security notifications, and rental reminders. You agree that these transactional emails are sent without additional consent as they are required to fulfill our service obligations to you.
